According to an interview with the Los Angeles Times, Samuel Jackson has stated
“There was a huge kind of negotiation that broke down. I don’t know. Maybe I won’t be Nick Fury. Maybe somebody else will be Nick Fury or maybe Nick Fury won’t be in it. There seems to be an economic crisis in the Marvel Comics world so [they're saying to me], ‘We’re not making that deal.’”
As the followers of Mark Miller’s “Ultimates” know, Sam Jackson’s “image” has replaced the original Colonel Fury in comicdom. The visage of the actor was a welcome change to the casual reader and gave us some hope that the AVENGERS would follow the Ultimates storyline.
Wake up, Marvel. You started down this path of continuity, so have faith in your creative properties and have the balls to continue with the same actors. You’ll make the cost up in the backend.
